Terms of Service

1. Who we are and what we offer

WishingWell (“WishingWell”, “we”, “us”, “our”) is a service that lets you collect products and experiences from different online stores into a single personal list — your wishlist — and discover new ones through our Showcase.

The Service comprises the website wishingwell.cloud and the web application available at app.wishingwell.cloud.

By using the Service you accept these Terms of Service. If you do not accept them, please do not use the Service.

2. What the Service is not

WishingWell does not sell the products and experiences shown in the Service. We do not hold them in stock, we do not ship them, and we do not process payments for them.

When you follow a link in the Service, you are taken to a third-party merchant’s website. Any purchase is made between you and that merchant, under their terms of sale. We are not a party to that contract.

We are therefore not responsible for the availability, prices, descriptions, quality, delivery times, returns, warranties or customer support relating to third-party merchants’ products. Product information shown in the Service is collected automatically from merchants’ websites and may be inaccurate or out of date: the information shown on the merchant’s own website at the time of purchase always prevails.

3. Affiliate links

Some links in the Service are affiliate links. If you make a purchase after following one of them, we may receive a commission from the merchant. This costs you nothing extra and does not affect the price you pay.

Affiliate commissions are one of the ways the Service sustains itself. We are committed to disclosing this clearly, as required by applicable law.

4. Your account

Registration. To use the wishlist you need to create an account by providing a valid email address and choosing a password. We will send you an email to verify your address.

Minimum age. You must be at least 16 years old to create an account. If your country requires a higher age to use an online service without the consent of a parent or guardian, that age applies.

Security. You are responsible for keeping your password confidential and for activity carried out through your account. Please tell us promptly about any unauthorised use.

Deletion. You can delete your account at any time from the settings section of the web application. Deletion permanently removes your account and the data associated with it, as described in our Privacy Policy. This action cannot be undone.

5. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

In particular, you agree not to:

• infringe our rights or those of other users or third parties, including intellectual property and privacy rights
• submit unlawful, offensive, defamatory, threatening or discriminatory content to the Service
• attempt to gain unauthorised access to the Service, its systems or other users’ accounts
• interfere with the operation or integrity of the Service
• create accounts by automated means, or create a new account after one of your accounts has been disabled for breaching these Terms
• extract the contents of the Service in bulk or by automated means
• resell, rent out or otherwise commercialise the Service or any part of it

6. Content you add

The content you add to your wishlist remains yours. You grant us only a limited, non-exclusive right to store it and display it back to you so that the Service can work.

Wishlists are private and are not visible to other users.

7. Availability of the Service

We aim to keep the Service available, but we cannot guarantee uninterrupted or error-free operation. The Service may be suspended for maintenance, updates, faults or causes beyond our control.

We reserve the right to modify, suspend or discontinue the Service, in whole or in part, giving reasonable notice where possible.

The Service is provided “as is”. To the extent permitted by law, we make no warranty that it will meet any particular requirement, or that the information it contains is complete or accurate.

8. Suspension and termination

We may suspend or close your account if you breach these Terms, or where your use creates risk or harm for us, for other users or for third parties.

You may stop using the Service at any time by deleting your account.

9. Limitation of liability

To the extent permitted by applicable law, we will not be liable for indirect damages, loss of profit, loss of data or loss of opportunity arising from your use of, or inability to use, the Service.

In particular, we are not liable for:

• products, services, contractual terms or conduct of third-party merchants
• inaccuracies in product information collected automatically from merchants’ websites
• temporary unavailability of the Service

Nothing in these Terms limits the rights you have as a consumer under mandatory applicable law, nor excludes our liability for wilful misconduct or gross negligence.

10. Changes to these Terms

We may change these Terms. Where changes are significant we will tell you through the Service or by email, with reasonable notice.

The effective date at the top of this document shows when it was last updated. Continuing to use the Service after a change means you accept the updated Terms. If you do not accept them, you can stop using the Service and delete your account.

11. Governing law and jurisdiction

These Terms are governed by the Albanian law, Tirana courts, without prejudice to mandatory consumer protection rules of the country of residence.

If you are acting as a consumer, the mandatory provisions of the country where you reside continue to apply, including your right to bring proceedings before the courts of your place of residence.

12. General provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force.

Our failure to exercise a right under these Terms does not amount to a waiver of that right.

You may not transfer your rights and obligations under these Terms without our written consent. We may transfer ours in the event of a merger, acquisition or sale of business, giving notice.

These Terms are drawn up in Italian and in English. In the event of any discrepancy, the Italian version prevails.
